Allegations of Disparate Impact in Healthcare

Using patient behavior patterns and spatial demographics, NERA rebutted a claim that the closure of a hospital by Premier Health Partners had a discriminatory and disparate adverse impact on the surrounding Black community, in violation of Title VI of the Civil Rights Act and Section 1557 of the Affordable Care Act. Based significantly on NERA’s analysis, the Office for Civil Rights at the US Department of Health and Human Services determined there was insufficient evidence to support the allegation of a violation.
