Niko Czaplicki assists law firms and their clients with expert economic analysis in complex arbitration proceedings, advises companies and regulators on competition matters, and provides regulatory due diligence advice to infrastructure investors. Tribunals and investors have been comfortable basing their decisions on his expert reports because of their high quality and reliability.
Mr. Czaplicki has participated in over 20 investment and commercial arbitration cases, as well as commercial litigations. He has been retained as a testifying expert on quantum of damages assignments, the economic assessment of hardship and price adjustments under long-term contracts, and matters of state aid. He has also assessed questions of causation in the development of regulatory regimes, additional costs resulting from construction delays, and damages in post-M&A disputes. Mr. Czaplicki has worked on economic and financial issues arising in disputes before ICSID, ICC, UNCITRAL, SIAC, and DIS tribunals.
Mr. Czaplicki has worked on projects in multiple industries including power generation (coal, lignite, gas, biomass, hydro, and offshore wind), oil and gas, electricity, gas and heat distribution and transmission, airports, rail, highway toll concessions, chemicals, industrial manufacturing, payments, telecommunications, and construction.
Drawing on his expertise in regulatory and energy economics, Mr. Czaplicki has provided regulatory and commercial due diligence advice in the power, natural gas, and hydrogen sectors in Germany, France, Luxembourg, Denmark, and the Czech Republic. He regularly advises regulated companies such as network operators and interconnectors in strategic questions arising from the energy transition and in negotiations with and appeals to regulatory authorities. Recent projects include cost of capital estimation in various jurisdictions and for a diverse set of assets, strategic advice to a European gas transmission operator during a potential conversion to hydrogen, and analysis of the impact of national and EU decarbonization plans for an electricity generation and district heating company investor.
Mr. Czaplicki also advises regulated companies and investors including airports and rail operators in the transport sector. He provided economic analyses and advice in the context of emerging EU data regulations (e.g., Digital Markets Act, Digital Services Act, and General Data Protection Regulation).
