Experience

With over 30 years of experience, Mark L. Berenblut is a leading expert in quantum, economics, finance, business valuation, accounting, and financial investigation. He has provided expert reports and expert witness testimony for complex matters involving economic damage quantum, insolvency and restructuring, financial investigation, white-collar crime, intellectual property, securities, and business valuations in domestic and international arbitrations under the rules of the ICC, AAA, Ontario Arbitration Act, and Israel Arbitration Act.

In international arbitration, Mr. Berenblut has provided expert evidence before arbitrators and panels in Europe, the US, Canada, and Israel, working on disputes spanning pharmaceutical patents, shareholder disputes, post-acquisition, and other contract disputes. He has also provided economic evidence before the European Court of Human Rights. Mr. Berenblut is recognized as a leading expert witness in arbitration by Who’s Who Legal: Arbitration, where he is described by clients as “a seasoned professional” renowned for his “excellent report writing and preparation” and “strong analytical skills.”

Mr. Berenblut specializes in providing business, securities, and intellectual property valuation and damage analysis in commercial, IP, and other disputes. His expertise includes the valuation of securities and business interests, brands, establishing royalty rates, patent portfolio valuation, valuation of intangibles, and other IP. He was a member of the Editorial Board of The Journal of Business Valuation and of the subcommittee of the CBV Institute’s Professional Practice Committee that revised the Institute’s Code of Ethics.

Mr. Berenblut provides expertise in insolvency and restructuring matters, particularly where they intersect with forensic investigation, business valuation, and economic damage quantification. He has been retained for leading insolvency cases, including matters related to the bankruptcies of Nortel, the Stanford Investment Bank, Enron, and Olympia and York Developments. Mr. Berenblut has also been retained on behalf of insurers, directors and officers, and boards in connection with numerous securities class action cases in Canada and the US and in regulatory hearings.

Mr. Berenblut is a Fellow Chartered Business Valuator and a Fellow Chartered Accountant. He has professional certifications as an Accredited Senior Appraiser, CPA, Certified Fraud Examiner, and AICPA-CFF. He is recognized by the Academy of Experts and has authored two books regarding damage quantification and the role of an expert: “Proving Economic Loss” and “The Litigator’s Guide to Expert Witnesses.” Prior to his current role, Mr. Berenblut was a managing partner of a US venture capital investment fund and a bio-science fund and a member of the investment committees of several major charitable foundations. He divides his time between Europe and North America.
