In 2020, the Supreme Court clarified the legal approach to passing-on, but new battlegrounds have emerged for claimants and defendants, direct and indirect purchases, and different class representatives on the expert evidence that will be needed to prove passing-on. This panel will discuss the legal test and what it means for the evidence and experts needed at trial.
