In cases of damages claims related to misstatements in securities reports, it is common practice to use economic analysis for damages calculation. It is well known that economic analysis has been employed to prove damages in major past lawsuits such as the Seibu Railway case, Livedoor case, IHI case, and Olympus case.
In this seminar, Tomohiko Yano, a director at NERA Tokyo Office who has supported clients in relevant cases, will explain the key points of damages calculation from an economic perspective, using relevant major case examples. Additionally, we will introduce both methods that were used in the previous major cases and the latest methods and examine the potential to perform high-quality, evidence-based damages estimation using both methods that were used in the previous major cases and the latest methods to clarify often contentious economic issues.
