2 April 2019/ New York City—NERA Economic Consulting is proud to announce Director Dr. Subramaniam Ramanarayanan, Associate Director Jennifer Cascone Fauver, and Associate Director Dr. Nicola Tosini won the Concurrences Antitrust Writing Award for Cross-Border Issues in the Business Articles category. Their article, “The Increasing Cross-Border Importance of Innovation in Merger Review,” was published in The Antitrust Magazine in 2018.

In their article, our experts provide guidance on navigating merger investigations where innovation concerns may feature prominently. The authors discuss:

  • The economic mechanisms underlying how mergers might affect the parties’ incentives to innovate;
  • Economic mechanisms in the context of recent merger reviews by US and EU antitrust authorities where concerns about innovation played an important role; and
  • The evidence and analyses used by the antitrust agencies to assess innovation effects.

The authors conclude that the trend in enforcement decisions, coupled with the recent stream of economic literature examining innovation effects, points to a regulatory environment where concerns regarding the impact of transactions on innovation will continue to play a major role.

Dr. Ramanarayanan and Ms. Fauver also received Concurrences writing awards in 2017 for their article, “Challenges for Economic Analysis of Mergers Between Potential Competitors: Steris and Synergy.”
