In addition, Tarek Badrakhan, Max Czernin, Ricardo Da Silva Rodrigues, Mattia Dolci, Leonie Janisch, Strahil Lepoev, Patrick McGervey, Ibrahim Ouf, David Ruiz, and Daniel Sullivan have been promoted to Senior Consultant. Elena Pascale and Jasmine Wu are now Consultants.

Director:

Mr. Czaplicki assists law firms and their clients with expert economic analysis in complex arbitration proceedings, advises companies and regulators on competition matters, and offers regulatory and strategic advice to infrastructure investors, regulators, and utilities. Mr. Czaplicki has given testimony on quantum of damages, the economic assessment of hardship and price adjustment requests under long-term contracts, and matters of state aid. He participated in more than 20 investment and commercial arbitration cases (ICSID, ICC, UNCITRAL, SIAC, and DIS) in different sectors, including energy (upstream oil and gas, refining and supply, power generation, renewables, district heating, and trading), natural resources and base materials (gold, silver, copper, oil, and aluminum), chemicals, automotive, and pharmaceuticals.

As an antitrust economist, Dr. Feyler has a decade of experience analyzing economic issues in litigation and investigations across a range of industries. She has analyzed antitrust liability and estimated damages in cases involving cartels, abuse of dominance, exclusionary conduct, tie-ins, and breach of contract. Dr. Feyler also has expertise evaluating the competitive effects of proposed mergers, acquisitions, and joint ventures. Her experience spans a number of industries, including digital platforms, telecommunications, health insurance, consumer products, and financial products.

Mr. Lindenlaub specializes in the economic analysis of the competitive effects of mergers and acquisitions, including transactions reviewed by the US Department of Justice, the US Federal Trade Commission, the Canadian Competition Bureau, and the European Commission. Mr. Lindenlaub’s merger work spans a range of industries, including software, e-commerce, financial and insurance services, medical devices, oil and gas, fertilizer, steel, railroads, industrial parts, automotive parts, consumer products, and retailing.

Ms. McIntosh has more than 20 years of experience in financial and economic advisory and litigation consulting for matters in the area of securities and finance, product liability and mass torts, and labor and employment. She has forecasted claims and the associated liability for a variety of torts, including those arising from allegedly toxic or faulty building products, automotive products, medical devices, and consumer products. She has developed statistical models to estimate the incidence of disease, claiming rates, and settlement values arising from exposure to asbestos, talc, and other fibers. Ms. McIntosh has performed reduction in workforce analyses and regularly conducts tests of statistical significance in cases alleging discrimination in hiring, pay, promotion, and termination decisions. In single plaintiff wrongful termination cases, she has estimated lost past and future wages, pension, and benefits. 

Senior Consultants:

Ms. Janisch is an energy economist who advises public and private clients, with a focus on the electricity and gas sectors across Europe. Her project experience includes international arbitration, auction support, impact assessments, and due diligence in the electricity and renewable energy sectors. Ms. Janisch advises on economic issues related to energy market developments and the regulation of renewable and conventional energy generation and networks. 

Mr. Badrakhan has assisted in preparing quantum and damages assessments for disputes before a number of courts including ICSID, ICC, PCA, DIFC, and SIAC. His case experience covers breach of contract disputes and government interventions and spans numerous geographies including the Middle East, Europe, Africa, and South America. He has worked on cases across sectors including energy, transport infrastructure (such as airports and roads), oil and gas, real estate, pharmaceuticals, and manufacturing. He is also experienced in regulatory economics, having advised network utilities and investors on issues such as regulatory risk and tariff setting.

Mr. Czernin works with private- and public-sector clients in the renewables, energy, and infrastructure sectors to answer questions of financial and regulatory economics and valuation. Mr. Czernin has worked on due diligence assignments for large transactions in the regulated UK networks sector, assisted UK and European utility companies on regulatory finance issues, and analyzed economic damages for prominent international arbitration cases. His recent experience includes the valuation of a range of offshore wind assets during an international arbitration proceeding against a European state. 

Mr. Rodrigues is a London-based financial economist. He specializes in quantum and damages assessments for litigation and international arbitration, as well as providing regulatory due diligence advice to infrastructure investors. Mr. Rodrigues has worked on a range of international and commercial disputes before the ICSID, ICC, and other high courts, including having provided testimony on the quantification of damages before the ICC.

Mr. Dolci provides economic analysis in litigation and international arbitration matters pertaining to securities and finance. He has examined issues relating to damages quantification, causation of loss, the price sensitivity of information, the share price impact of alleged accounting misstatements, market efficiency, class certification, and settlement prediction. Mr. Dolci has experience managing and consulting on more than 30 cases involving securities class actions, breaches of contract, and valuations.

Dr. Lepoev advises clients during antitrust reviews of mergers and acquisitions and allegations of anticompetitive conduct. In his work on litigation cases, Dr. Lepoev has analyzed allegations of anticompetitive conduct in the syndicated data provision industry and the pharmacy benefits industry. He specializes in applied microeconomics, industrial organization, and econometrics.

Mr. McGervey conducts economic analyses of issues related to regulation, intellectual property rights, consumer protection, and competition to support clients involved in regulatory proceedings, arbitration, complex litigation, merger reviews, and public policy debates.

Mr. Ouf works with regulators, industry-leading companies, and governments to provide rigorous economic analysis across the energy industry, including for utilities, oil and gas, and energy companies and transportation companies. He advises clients on their strategic and operational goals using trusted financial, strategic, and public policy analysis. Mr. Ouf has provided economic damages analyses to utilities and natural gas companies across North America. He has worked with several investor-owned utilities in supporting regulatory rate cases against state and federal energy regulatory commissions. Mr. Ouf has also supported transportation companies in assessing economic and financial impacts related to competitive and antitrust circumstances.

Dr. Ruiz specializes in the economics of antitrust, competition, and market design. He has analyzed economic issues in a variety of industries, including digital platforms, data markets and technology, healthcare, and consumer products. His research includes the economics of AI, matching-based market design, auctions, algorithmic pricing, machine-learning, and econometric analysis. Dr. Ruiz currently serves as the Young Economist Representative of the Pricing Conduct Committee to the ABA Antitrust Section.

Mr. Sullivan is an antitrust economist experienced in assessing damages and class certification issues in antitrust litigation. He also has experience evaluating economic questions in market investigations, merger reviews, and international arbitration matters. Mr. Sullivan’s experience spans various industries, including higher education, financial data, banking and payments, telecoms, construction, and automobiles.
